MINUTES
I. CALL TO ORDER:
The meeting was called to order by the Chairman, Mr. Albert, at 7:03 p.m.
II. ROLL CALL:

III. ANNOUNCEMENT OF EXECUTIVE SESSION:
Mr. Albert advised that an executive session was held prior to this meeting to discuss personnel issues and police matters.
IV. RECOGNITION OF PUBLIC:
Ms. Karen Sandnes, 121 Yellow Breeches Drive, advised the Board that her home was severely flooded on April 16, 2011 and is now uninhabitable. She spoke about the FEMA Mitigation Grant Program. Under this program, FEMA would pay 75% of the property value and the Township would pay the other 25% and take possession of the property. She asked the Township to execute the application on her behalf. Mr. Albert said that while the Board is sympathetic to the flood victims, there are no funds available to purchase, demolish and rehab the property. Mr. Brown also stated that the Township cannot afford to buy any properties. Mr. Pirritano said there may be a 90% grant – he will look into it this week and advise Ms. Sandnes.
V. AGENDA ITEMS:
1. Subdivision Plans:
A. Modification Requests:
1. Langletz, 920 Limekiln Road
Mr. Smith advised that at the last meeting, the Board took action on modification requests for this plan. There was some confusion, several inconsistencies in the plan and it appears that certain items were not fully disclosed so that the vote was not based on all the correct information. It is recommended that the Board rescind the action taken on these modifications and reconsider all three requests based on the correct information provided.
Mr. Pirritano made a motion, seconded by Mr. Brown to rescind the action taken at the meeting of May 23, 2011 on modification requests for 602.2.C, cartway widening, 606.3.B, multiple access drives and 701, complete stormwater report.
Vote on the motion: All yes. The motion carried.

2. Langletz, 920 Limekiln Road:
a. 602.2.C – Cartway Widening
After lengthy discussion and the recommendation of the Engineer and Public Works Superintendant that the entire length of the PA Landscape property be widened, Mr. Brown made a motion, seconded by Mr. Mickle to deny the modification request for 602.2.C, Cartway Widening.
Vote on the motion: All yes. The motion carried.
b. 606.3.B – Multiple Access Drives
Mr. Waller explained that the applicant’s engineer has indicated that the two illegally installed driveways will be removed, a culvert pipe will be installed in accordance with DEP requirements to allow access over the stream from an existing driveway and a new plan will be submitted showing these changes. This waiver will then not be needed and is withdrawn.
c. 701 – Complete Stormwater Report
Mr. Mickle made a motion, seconded by Mr. Brown to approve the modification request for 701 – Complete Stormwater Report.
Vote on the motion: All yes. The motion carried.
Mr. Langletz addressed the Board and stated that in his opinion, the road was not constructed properly in the first place and now he is being blamed for the condition of the roadway.
3. Shettel/Stoneberger – Schoolhouse Lane:
a. 602.2.C – Cartway Widening
Mr. Mickle made a motion, seconded by Mr. Brown to approve the modification request for 602.2.C – Cartway Widening, for that portion of the Shettel property being transferred to Stoneberger and added to the existing Stoneberger tract which abuts the Shettel property, with a note on the plan that if the Stoneberger farm is ever developed, the Cartway Widening portion of the ordinance will be required.
Vote on the motion: All yes. The motion carried.
4. Mil-Base Industries, Inc., 197 Old York Road:
a. 305.2.A – Minor Land Development Plan
Mr. Brown made a motion, seconded by Mr. Pirritano to approve the modification request for Mil-Base Industries from 305.2.A – Minor Land Development Plan.
Vote on the motion: All yes. The motion carried.
5. Shettel Farm Revised Plan:
a. Bonding for Preliminary/Final Subdivision Plan
Michael Martin stated that as a condition of prior approval of this plan, he was required to place a cash bond in the amount of $31,575.00. He proposes that if the Board will not require the road improvements on Schoolhouse Lane he will enter into an agreement that the funds can be used on roadways in the Township as the Board deems appropriate.
Mr. Pirritano made a motion, seconded by Mr. Brown that Schoolhouse Lane be widened by the developer. Mr. Martin agreed.

B. Preliminary/Final Land Development Plan – Langletz, 920 Limekiln Road:
Mr. Mickle made a motion, seconded by Mr. Brown to table action on this plan.
Vote on the motion: All yes. The motion carried.
C. Final Subdivision Plan – Shettel/Stoneberger Lot Consolidation Plan, Schoolhouse Lane:
Mr. Brown made a motion, seconded by Mr. Mickle to approve the final subdivision plan for Shettel/Stoneberger lot consolidation plan, contingent upon favorable action on the modification request above; submittal of signed and notarized plans; payment of recording fees; payment of all engineer fees; compliance with the Township Staff memo dated June 20, 2011; signatures of all parties; and a note on the plan that if the Stoneberger farm is ever developed, the Cartway Widening portion of the ordinance will be required.

Mr. Mickle made a motion, seconded by Mr. Brown to approve the ten (10) time extensions as listed above.

2. Waiver Request – Lower Allen Township Authority, Beacon Hill Blvd.:
Mr. Pirritano made a motion, seconded by Mr. Brown to approve the request from Lower Allen Township Authority to waive Land Development Plan submission and all associated fees, for their Phase 2 Wastewater Treatment Plant BNR Upgrade Project.
Vote on the motion: All yes. The motion carried.
3. Advanced Tactical Rescue Team Response:
Mr. Pirritano made a motion, seconded by Mr. Mickle to decline the request to add the York County Advanced Tactical Rescue Team to the first alarm box and keep as the number 2 alarm box as is the current practice, on the written recommendation of the Fire Chief as follows:
“Unlike other areas, our apparatus dispatch listings already have a certified technical rescue team on automatic initial dispatch from the Army Depot. The York ATR and Harrisburg Task Force 1 are listed as automatic at the next level of response, to be determined by the technical rescue experts from the Army Depot or Incident Command. If the Army Depot is unavailable, the York County ATR automatically moves up to automatic initial dispatch as determined by the York County CAD System.
Since the closest York County ATR unit is located in Dover Township, approx. 40 minutes away, with a heavy rescue coming from Shrewsbury, about 50 minutes away, we believe that our current apparatus dispatch listings meet the needs of our township more appropriately. The Army Depot is 5 min and Harrisburg Task Force 1 is 15 min, both paid services. The York service is mostly volunteer.
Although we respect the quality and professionalism of the York service, and we would never exclude them from an actual technical rescue incident, we recommend that we keep the apparatus listings (boxes) as they currently stand, with the Army Depot on first dispatch, and York ATR and Harrisburg TF1 on second alarm. 4. Letter of Support – York County Hazard Mitigation Plan Update:
Mr. Mickle made a motion, seconded by Mr. Brown to authorize staff to participate in the York County Hazard Mitigation Plan update.
Vote on the motion: All yes. The motion carried.
5. Resignation – Zoning Hearing Board:
Mr. Mickle made a motion, seconded by Mr. Pirritano, to accept, with reluctance, the resignation of James Steeley from the Zoning Hearing Board.
Vote on the motion: All yes. The motion carried.
6. Appointment – Zoning Hearing Board:
Mr. Mickle made a motion, seconded by Mr. Brown to appoint Robert P. Stanley, Jr. to fill an unexpired term on the Zoning Hearing Board to January, 2014.
Vote on the motion: All yes. The motion carried.
7. Resignation – Authority:
Mr. Mickle made a motion, seconded by Mr. Brown to accept, with regret, the resignation of Robert P. Stanley, Jr. from the Fairview Township Authority.
Vote on the motion: All yes. The motion carried.

8. Authorization to Advertise Ordinance – Designation of Approved Towing Services:
Mr. Brown made a motion, seconded by Mr. Pirritano to authorize staff to advertise the ordinance, as presented, amending Chapter 15, Section 504, designation of approved towing services.
Vote on the motion: All yes. The motion carried.
9. Unsignalized Intersection Safety Strategies – PennDOT
Mr. Smith explained the new signage and road markings to be placed by PennDOT at the intersection of Poplar Road, Lewisberry Road and Springers Lane. PennDOT will also trim the trees and brush on Poplar and Lewisberry and the Township will trim trees on Springers Lane.
10. Discussion – Refuse Collection Contract:
Mr. Smith reviewed the draft contract and explained some of the proposed changes to the current contract. He advised that the bid must go out no later than August 1 so it can be awarded at the September meeting. There was a general discussion of the various options available and Mr. Smith asked the Board for their input before the bid is advertised.
11. Discussion – Sidewalk Ordinance:
Mr. Smith asked the Board to review the draft of the ordinance they were provided so that it can be approved for advertisement at the July meeting.
12. Discussion – Debt Issue:
Mr. Smith discussed the refinancing of the sewer bond issue and advised that Frank Leber, Rhoads & Sinon, will attend the July meeting to address the Board on this matter.
13. Zoning Hearings:
There was no discussion on the scheduled hearings.
VI. OLD BUSINESS:
There was no old business discussed.

VII. NEW BUSINESS:
Mr. Mickle suggested that since his term will be up at the end of the year and Chris Allen will be taking office in January that Mr. Allen be given a copy of the towing ordinance and notified of the schedule of budget meetings.
VIII. APPROVAL OF MINUTES – May 23, 2011:
Mr. Albert made a motion, seconded by Mr. Pirritano to approve the minutes of the May 23, 2011 Board of Supervisors meeting.
Vote on the motion: All yes. The motion carried.
IX. RATIFICATION OF BILLS PAYABLE:
Mr. Albert made a motion, seconded by Mr. Brown to ratify payment of all Bills Payable as presented.
Vote on the motion: All yes. The motion carried.
X. ANNOUNCE EXECUTIVE SESSION:
Mr. Albert advised that there will be an Executive Session following this meeting.
XI. ADJOURNMENT:
